Cedar Gift draws its own country designs — tractors, pickups, barns, bucks, mallards, water towers and small-town main streets — and we expect the same respect for creative work from everyone who uses our site. This page explains how to tell us if you believe something on cedargift.shop infringes a copyright you own or represent, what your notice needs to contain, what we do when we receive it, and how a person whose material was removed can respond. It follows the notice-and-takedown process of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Trademark and other intellectual property questions are covered by our Intellectual Property Policy.
The short version
- Send copyright notices by email to [email protected] with the subject line “Copyright notice”.
- Include all six required elements listed in section 3, including the exact URL of the material.
- We review complete notices promptly and remove or disable material that infringes.
- If your own material was removed by mistake, you can send a counter-notification (section 6).
- Knowingly false notices can carry legal liability.
1. What this page covers
This page applies to everything published on cedargift.shop: product designs and product images, category tiles and banners, product descriptions, policy and help pages, and anything customers submit to the site, such as reviews or review photos if those are enabled. Cedar Gift is a single shop selling its own products; there are no outside sellers listing items here. That means any concern about a design on our site comes to us directly, and we deal with it ourselves.
It does not cover what customers type into personalisation fields on their own orders before printing; that text is handled under our Terms of Service and our Intellectual Property Policy, which do not allow brand names, team names, logos or copyrighted characters in personalisation.
2. Before you send a notice
Many of the subjects on our products are everyday country scenes that nobody owns: a red barn with a star on the gable, round bales in a snowy field, a buck at the edge of the timber, a pickup with a tree in the bed, a white church on a hill. Copyright protects a particular drawing or photograph, not the general idea of a tractor or a mallard. If you believe one of our designs copies your specific artwork or photograph — the same composition, lines, details or text — a notice is the right step. If you are unsure whether your work is protected or copied, you may want to speak with a lawyer first; section 7 explains why.
If your concern is about a name, logo or brand rather than a drawing or photo, please use the process in our Intellectual Property Policy instead.
3. What a copyright notice must contain
To be complete, your written notice must include:
- A physical or electronic signature of the copyright owner or of a person authorised to act on the owner’s behalf.
- Identification of the copyrighted work you believe has been infringed — for example a link to your original artwork, the title of the work, or a copy of it attached to the email.
- Identification of the material on our site that you believe is infringing, with the exact URL of each product or page, and if a product has several images, which image.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.
Send it to [email protected] with the subject “Copyright notice”. You can also post a written notice to Cedar Gift, 29115 Valley Center Road #K207, Valley Center, CA 92082, US, but email reaches us faster. A notice that leaves out any of the six elements may delay our response; we will tell you what is missing.
| Element | Example of what to include |
|---|---|
| Signature | Typed full name at the end of the email |
| Your original work | Link to your portfolio page or the original file |
| Material on our site | Full product URL and which image |
| Contact details | Name, postal address, phone, email |
| Good-faith statement | One sentence, as worded in item 5 above |
| Accuracy and authority statement | One sentence under penalty of perjury, as in item 6 |
4. What we do when a notice arrives
We acknowledge your notice by email within 24 hours on business days and review it promptly. If the notice is complete and the material appears to infringe, we remove the design or image from the site or disable access to it, and we confirm to you by email what we did. Where a product depends on the design, we take the product down as well and stop selling it.
If we need more information to identify the material or to understand your claim, we ask you before deciding. If we conclude that the material does not infringe — for example because it is our own original drawing of a common subject — we explain our reasons to you in writing.
5. Material submitted by customers
If the material you report was submitted by a customer, for example a photo attached to a review, we remove it when the notice is valid and tell the customer who posted it that it was removed because of a copyright notice. Where the law allows, we share a copy of the notice with your personal contact details withheld, so the customer can decide whether to send a counter-notification.
6. Counter-notification
If material you submitted was removed and you believe that happened because of a mistake or a misidentification, you may send us a counter-notification. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the URL where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, postal address and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for your address (or, if your address is outside the United States, any judicial district in which Cedar Gift may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We forward a valid counter-notification to the person who sent the original notice. Under the law, the material may be restored in 10 to 14 business days after we receive the counter-notification, unless the original notifier tells us they have filed a court action to stop the infringement.
7. False or misleading notices
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please make sure your notice or counter-notification is accurate. If you are not certain your rights are being infringed, consider getting legal advice first.
8. Repeat infringement
We remove content from, and may close the accounts of, customers who repeatedly submit material that infringes other people’s copyrights.
9. How the process runs, step by step
| Step | Who acts | What happens |
|---|---|---|
| 1. Notice sent | Rights owner or agent | Email with all six elements and the exact URLs |
| 2. Acknowledgement | Cedar Gift | Reply within 24 hours on business days |
| 3. Review | Cedar Gift | We compare the work and the material and ask questions if needed |
| 4. Removal | Cedar Gift | Valid notice: material removed or disabled and the notifier told |
| 5. Counter-notification | Person whose material was removed | Optional; forwarded to the notifier when valid |
| 6. Possible restoration | Cedar Gift | 10 to 14 business days after a valid counter-notification, unless a court action is filed |
10. Orders already placed for a removed design
If a design is removed after a valid notice, we stop selling it straight away. Customers who already ordered that product and have not yet received it will hear from us by email; they can choose a different design or a full refund, which is sent within 7 days of our confirmation. Customers who already received the product keep their usual 60-day return right under our Returns & Exchanges Policy.
11. Notices about content outside our site
This process covers material published on cedargift.shop only. If you find something infringing on another website, marketplace or social media account that is not run by us, please contact that site’s operator directly; we have no control over it. If that other site is copying Cedar Gift’s own designs or photos, we would like to know so that we can follow up ourselves.
12. Privacy of the information in a notice
A notice includes personal details such as your name, address and phone number. We use them only to handle the notice and, where the law requires, share them with the person whose material was removed so they can respond. We keep notices and counter-notifications for as long as they are needed to deal with the matter and any follow-up.
13. Our own designs and how to use them
Our ornaments, signs and apparel carry drawings made for Cedar Gift. Sharing a link to a product page is always welcome; copying an image or a design onto another product is not.
The designs on Cedar Gift products and the images on cedargift.shop are protected by copyright too. If you would like to use one of them — for a club newsletter, a school fundraiser or anything else — please ask first by email. If you find our designs or product photos copied on another site or marketplace, we would be grateful if you let us know at [email protected].
14. Other ways we can help
Not every concern needs a formal notice. If you simply think one of our designs looks too close to something you have seen, or you have a question about how we create our artwork, write to us in plain words and we will look into it. For questions about orders, use Contact Us or the Help Center rather than this process, so your message reaches the right place quickly.
15. Contact for copyright matters
Email [email protected] with the subject “Copyright notice” or “Counter-notification”. Postal address: Cedar Gift, 29115 Valley Center Road #K207, Valley Center, CA 92082, US. See also our Terms of Service, our Intellectual Property Policy and our Privacy Policy, which explains how we handle the personal details included in a notice.
